This Affiliate Policy governs participation in the Nutomo Affiliate Program.
Nutomo is a brand powered by Velivion Ltd, a company registered in the Republic of Cyprus under registration number HE 495527.
References in this Affiliate Policy to “Nutomo”, “we”, “us” or “our” refer to Velivion Ltd operating the Nutomo brand.
By applying for or participating in the Nutomo Affiliate Program, you agree to this Affiliate Policy.
1. Nutomo Affiliate Program
The Nutomo Affiliate Program allows approved affiliates to promote Nutomo and earn commissions on qualifying purchases attributed to their affiliate account.
Participation is subject to approval by Nutomo.
We may accept or reject an application where reasonably necessary to protect the Nutomo brand or the integrity of the program.
2. Commission
Approved affiliates may earn up to 30% commission on qualifying Nutomo purchases, subject to the specific commission rate assigned to their affiliate account.
Your applicable commission rate will be communicated through your affiliate account, program page or written confirmation from Nutomo.
Commission is calculated on the eligible net purchase amount, excluding where applicable:
- taxes;
- refunded purchases;
- chargebacks;
- fraudulent transactions;
- duplicate transactions;
- cancelled orders; and
- amounts otherwise excluded under your specific affiliate arrangement.
3. One-Time Purchases
Unless Nutomo expressly states otherwise for a specific product or service, commission is payable on the qualifying transaction attributed to the affiliate.
A Nutomo theme purchase does not automatically create a recurring commission simply because the customer continues using the product.
If Nutomo introduces subscription based products or recurring commissions in the future, the applicable terms will be communicated separately.
4. Attribution
Sales must be tracked through the affiliate link, referral code or tracking method supplied by Nutomo.
Attribution will be determined according to the tracking rules and attribution period communicated through the Nutomo Affiliate Program.
Nutomo is not responsible for commissions that cannot be tracked because of:
- deleted or blocked cookies;
- privacy software;
- browser restrictions;
- incorrect affiliate links;
- customer device changes;
- third-party tracking restrictions; or
- other circumstances outside our reasonable control.
5. Commission Validation
A commission becomes eligible for payment only after the underlying transaction has been successfully paid and any applicable validation, fraud review or refund period has passed.
Pending commissions do not constitute an amount owed until validated by Nutomo.
6. Refunds and Chargebacks
If a transaction is refunded, cancelled, reversed, disputed or determined to be fraudulent, any related commission may be cancelled.
If the commission has already been paid, the amount may be deducted from future affiliate earnings where legally permitted.
7. Affiliate Payouts
Payment schedules, minimum payout thresholds, supported currencies and payment methods will be communicated through the Affiliate Program or affiliate dashboard.
Affiliates are responsible for providing accurate payment information.
Affiliates are responsible for their own tax reporting and tax obligations relating to affiliate earnings.
8. Affiliate Disclosure
Affiliates must clearly disclose their commercial relationship with Nutomo wherever required by applicable advertising, consumer protection or endorsement laws.
The disclosure must be clear and reasonably visible to the audience.
Affiliates must not conceal the fact that they may receive compensation from purchases made through their referral links.
9. Honest Marketing
Affiliates must accurately represent Nutomo.
You must not make false, misleading, exaggerated or unsubstantiated claims, including guarantees relating to:
- sales;
- income;
- conversion rates;
- SEO rankings;
- ecommerce success;
- revenue;
- savings; or
- business performance.
You may use claims and marketing materials officially supplied or approved by Nutomo, provided they are used in the intended context.
10. Prohibited Promotional Methods
Unless expressly authorised in writing by Nutomo, affiliates may not:
- send unsolicited commercial messages or spam;
- engage in cookie stuffing;
- use forced clicks;
- generate fraudulent referrals;
- purchase Nutomo through their own affiliate link;
- create fake accounts or transactions;
- impersonate Nutomo or Velivion Ltd;
- represent themselves as an employee or official representative of Nutomo;
- use deceptive redirects;
- publish fabricated reviews;
- create misleading Nutomo discount or coupon pages;
- advertise nonexistent coupons or promotions;
- use malware, adware, spyware or other harmful software;
- promote Nutomo on illegal, deceptive, hateful or infringing websites;
- offer unauthorised cashback or incentives;
- redistribute Nutomo files; or
- facilitate piracy or unauthorised theme sharing.
11. Paid Search and Advertising
Unless Nutomo gives prior written approval, affiliates may not bid on Nutomo branded search terms including:
- Nutomo;
- Nutomo.com;
- Nutomo Theme;
- Nutomo Shopify Theme;
- Velivion;
- common misspellings of these names; or
- other Nutomo trademarks.
Affiliates must not create paid advertisements that could reasonably cause a user to believe that the advertisement is operated directly by Nutomo.
Direct linking from paid search advertising to Nutomo using an affiliate link is prohibited unless expressly approved.
12. Domains, Social Accounts and Branding
Affiliates may not register or use domain names, social media usernames, application names or business names that contain Nutomo, Velivion or confusingly similar variations without written permission.
Affiliates must clearly remain independent from Nutomo.
13. Nutomo Marketing Materials
Approved affiliates receive a limited, revocable, non-exclusive licence to use official Nutomo marketing materials solely for promoting Nutomo through the Affiliate Program.
You may not:
- claim ownership of Nutomo branding;
- substantially modify trademarks;
- use outdated or misleading promotions; or
- use Nutomo branding after leaving the Affiliate Program.
14. Coupons and Promotional Codes
Only coupons and discount codes expressly issued or approved by Nutomo may be advertised.
Affiliates must not:
- invent Nutomo coupon codes;
- advertise expired codes as active;
- advertise a discount where none exists; or
- use misleading terms such as “official coupon” unless authorised.
15. Sub-Affiliates
You may not operate a sub-affiliate network using the Nutomo Affiliate Program without prior written approval.
You remain responsible for any approved sub-affiliates operating under your account.
16. Intellectual Property
Nutomo, Nutomo.com, logos, graphics, themes, product names, marketing materials and other intellectual property remain the property of Velivion Ltd or their respective licensors.
Participation in the Affiliate Program does not transfer ownership of any intellectual property.
17. Monitoring and Compliance
Nutomo may review affiliate activity to protect customers, prevent fraud and ensure compliance with this Affiliate Policy.
We may request information about traffic sources or promotional methods where reasonably necessary.
Failure to provide requested information may result in commissions being placed on hold while the matter is investigated.
18. Suspension and Termination
Either party may end the affiliate relationship.
Nutomo may immediately suspend or terminate an affiliate account where there is reasonable evidence of:
- fraud;
- spam;
- misleading marketing;
- trademark abuse;
- self-referrals;
- manipulation of attribution;
- unlawful activity;
- piracy;
- abuse of Nutomo customers; or
- material violation of this Affiliate Policy.
Commissions generated through prohibited or fraudulent activity may be cancelled.
Legitimate, validated commissions earned before termination will be handled according to the applicable program terms.
19. Independent Relationship
Affiliates participate as independent contractors.
Nothing in this Affiliate Policy creates an employment relationship, partnership, agency, franchise or joint venture between the affiliate and Velivion Ltd.
Affiliates have no authority to enter into agreements on behalf of Nutomo or Velivion Ltd.
20. Changes to the Affiliate Program
Nutomo may change commission structures, attribution rules, promotional requirements or other program terms.
Where practicable, material changes affecting active affiliates will be communicated through the affiliate dashboard, email or program page.
21. Limitation of Liability
To the maximum extent permitted by law, Velivion Ltd is not liable for indirect or consequential losses resulting from participation in the Affiliate Program, tracking interruptions, third-party platform changes or loss of anticipated commissions.
Nothing in this Affiliate Policy limits liability where limitation is prohibited by law.
22. Governing Law
This Affiliate Policy is governed by the laws of the Republic of Cyprus.
